Terms of Use
Last updated: 5 August 2026
1. Agreement to these terms
These Terms of Use ("Terms") are a legal agreement between you and Mustafa Yiğit Şahin, an individual developer based in Türkiye ("we", "us"), governing your use of the Birdy iOS application and this website (together, the "Service"). By downloading, installing, or using Birdy, you agree to these Terms. If you do not agree, please do not use the Service.
2. Licence to use Birdy
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use Birdy on Apple devices that you own or control, for your own personal, non-commercial use, in accordance with these Terms and the App Store Terms of Service.
3. Subscriptions, trials and purchases
- Birdy offers auto-renewing subscriptions (for example, monthly and yearly) and a one-time lifetime purchase that unlock the app's paid features.
- A free trial may be offered on certain plans. If you do not cancel at least 24 hours before the trial ends, it automatically converts to a paid subscription and your Apple ID is charged.
- Subscriptions auto-renew unless you cancel at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours before each period ends.
- You manage and cancel subscriptions in your App Store account settings, not inside Birdy. Deleting the app does not cancel a subscription.
- Prices are shown in the app in your local currency and may change; any change will apply only to future billing periods.
- All payments are processed by Apple. Refunds are handled by Apple under its policies; we do not process payments or refunds directly.
4. Alarm reliability — please read
Birdy is designed to be a hard-to-dismiss alarm, but we cannot and do not guarantee that an alarm will sound, or that it will wake you, in every situation. Alarms can fail for reasons outside our control — including a powered-off or restarted device, a dead battery, silent mode or Focus/Do Not Disturb settings, low-power mode, revoked permissions, operating-system changes, or hardware and software faults.
Do not rely on Birdy alone for anything critical — such as catching a flight, taking medication on time, work or safety-critical wake-ups. Always use an independent backup alarm for important events.
To the maximum extent permitted by law, we are not liable for any missed alarm, oversleeping, or any resulting loss or damage.
5. Acceptable use
You agree to use Birdy only for lawful, personal purposes, and not to: copy, modify, or create derivative works of the app; reverse engineer, decompile, or attempt to extract its source code except where permitted by law; resell, sublicense, or commercially exploit the app; or interfere with its security or intended operation.
6. Intellectual property
Birdy, including its name, mascot, design, and software, is owned by us and protected by intellectual-property laws. These Terms do not transfer any ownership rights to you; you receive only the limited licence described above.
7. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that it will meet your requirements.
8. Limitation of liability
To the maximum extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from missed alarms or your use of (or inability to use) the Service. Where liability cannot be excluded, our total liability is limited to the amount you paid for the Service in the twelve months before the claim arose. Nothing in these Terms limits liability that cannot be limited under applicable law.
9. Apple App Store terms
The following apply because Birdy is distributed through Apple's App Store:
- These Terms are between you and us only, not with Apple. Apple is not responsible for Birdy or its content.
- Apple has no obligation to provide any maintenance or support for Birdy.
- To the extent permitted by law, Apple has no warranty obligation for Birdy, and any warranty claims are our responsibility, not Apple's.
- Apple is not responsible for addressing any claims relating to Birdy, including product-liability, legal or regulatory, or intellectual-property claims.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
10. Changes to these terms
We may update these Terms from time to time. When we do, we'll change the "Last updated" date above and post the revised Terms here. Your continued use of the Service after changes take effect means you accept the updated Terms.
11. Governing law
These Terms are governed by the laws of the Republic of Türkiye, without regard to its conflict-of-law rules. Mandatory consumer-protection rights you have in your country of residence are not affected.
